Legal Pluralism and Shariah Law: Comparative Approaches and International Insights

Abstrak

This study explores the dynamics of legal pluralism and its impact on the application of Shariah law across different national contexts. As Shariah law increasingly interacts with civil, customary, and international legal systems, reconciling multiple legal frameworks has become a critical challenge. Using a qualitative comparative approach, data were collected through literature review, case studies, and expert interviews from countries implementing Shariah alongside other legal systems. The results indicate that successful integration requires context-sensitive jurisprudence, institutional innovations, and dialogue among legal, religious, and policy stakeholders. Comparative insights highlight diverse approaches, including hybrid legal frameworks, codified Shariah provisions, and regulatory mechanisms for Islamic finance. The study underscores the need for harmonized yet flexible legal strategies that preserve Shariah principles while ensuring social justice, legitimacy, and compliance with international norms
